Article 74 of the Indian constitution states that there shall be a Council of Ministers headed by the Prime Minister to aid and advice the President.
- The President appoints the Prime Minister and the other Council of Ministers are appointed on the advice of the Prime Minister.
- Prime Minister allocates ranks and portfolios to the ministers. The rank of a cabinet minister, minister of state or deputy minister is decided on the basis of seniority and political importance.
- 91st Constitutional Amendment Act limits the size of the Council of Ministers to 15% of the total number of members of the Lok Sabha.
- The Council of Ministers is collectively responsible to the Lok Sabha (Article 75(3))
- The death or resignation of the Prime Minister leads to the dissolution of the entire council of Ministers.
- The Prime Minister acts as a link between the Council of Ministers and the President.
