Governor is the executive head of the State and all the executive actions are taken in his name. A governor is the representative of the Central Government and acts as a bridge between the state and the central government. The governor is appointed by the President of India and holds office during the pleasure of President. Everything related to Governor, i.e. his appointment, removal, powers and functions, etc. are mentioned under Article Art 153 to Art 162 of the Indian Constitution.

Appointment of a Governor

The governor of a state is appointed by the president of India (article 155). He/ She could be the Governor of more than one state at a time (Article 153).

Term of Governor’s office

The Governor shall hold office during the pleasure of the President (Article 156). The normal duration of office is five years but may be terminated earlier by

(i) Dismissal by the President or

(ii) Resignation addressed to the President.

Duties, Responsibilities and Powers of the Governor

  • The President consults the Governor in the appointment of the Judges of the state High Court.
  • The Governor has the power to pardon; he cannot pardon a death sentence.
  • Signing or vetoing bills passed by the Legislature.
  • Serves as commander-in-chief of the state's military forces.
  • Declaring special elections to fill vacancies in certain elected offices.
  • Governor can nominate one member in the state legislative assembly and one-sixth members of the legislative council.
  • In case no political party bags a majority in the Vidhan Sabha of the state, the Governor holds power to use his discretion to select the Chief Minister.

NOTE: The powers of Governor and Lt. Governor are more or less similar. Lt. Governor is also appointed by the President of India. 

Article 239 states that every UT in India shall be administered by the President through appointment of an administrator.

The Chief Justice of the concerned State/UT High court administers the oath of office to the Governor/Lieutenant Governor. In his absence, senior most-judge of High Court or acting Chief Justice administers the oath.
